Chapter 28
Dan huddled around the kitchen table with Garrett and Jimmy. The mood was dark and their expressions were grim. Garrett was not noodling on his keyboard and Jimmy was not playing with his action figures, so he knew they felt the ominous mood just as profoundly as he did. âI donât think Iâve ever gone into a trial feeling less sure of myself. Or of my case.â
âDonât beat yourself up,â Garrett said. âI know the hours youâve been pulling. Youâve left no stone unturned.â
âAnd yet, there are still so many unturned stones. Iâve been over all the evidence provided by the prosecution, but I canât shake the feeling that thereâs something more. Something important we donât know.â
âThe prosecution has to produce all exculpatory evidence,â Jimmy reminded him. âIâve talked to Shawna and my other pals at the courthouse. She doesnât think the DA is up to anything sneaky.â
âAnd yet we know heâs bringing in a ringer to prosecute. Thatâs another problem. I donât even know who my opponent is yet.â
âThe word on the street is that Belasco is tired of being beaten in the courtroom by you. I think there was some concern that...you and Jazlyn are getting too chummy. When the prosecutor and the defense counsel start attending the same birthday parties...â
âWe donât have to pretend to be hostile to do our jobs properly.â
Jimmy raised his hands defensively. âHey, donât kill the messenger. Iâm just suggesting a possible reason for hiring an outside prosecutor. Belasco wants to win.â
âHave you had a chance to review my witness outlines?â Garrett asked.
âRepeatedly. You did the usual fantastic job Iâve come to depend upon.â
âI predict the prosecution will come on strong. They almost have to, given the circumstances. They donât have a body. Theyâre only guessing about how the murder was committed.â
âWhen witnesses come on strong, when they stick to their guns despite all evidence to the contrary, jurors stop believing them.â A light bulb flashed in his brain. âOh hell. Judge Smulders asked for trial briefs. Why would he do that?â
Jimmy shrugged. âBecause he has no idea what heâs doing.â
âProbably heard the phrase âtrial briefâ and thought it sounded cool. Has no idea what a waste of time they are.â
âOnly a waste of time if you have to write them. In his case, anything might help.â
âThat babe-in-the-woods is not remotely ready to preside over a death case.â
âHave you considered filing a complaint?â Garrett asked. âAsk the chief judge to appoint someone else?â
âAnd make an enemy for life? Possibly several?â
âBetter than letting our client be executed because the judge is incompetent.â
âI think thatâs a bad idea,â Jimmy said. âIn the first place, I donât think it would work. Youâd just end up with a trial judge who thinks you donât like him, so he constantly rules against you. In the second place, it looks like youâre running scared.â
âWe are running scared.â
âBut we donât want it to show, right?â
He frowned but acquiesced. âI suppose I can carve out some time tonight to write the brief.
